Parties and Consent
Tut tut attaches particular importance to protecting the Personal Data of users on its platform.
The site
The www.tut-tut.com website (referred to as the «Site») is published by CLV.
CLV is a simplified joint stock company with a single shareholder and a capital of €66,729.00. Its registered office is located at 114 route des Rémouleurs, 84000 AVIGNON. SAS CLV is registered in the Avignon Trade and Companies Register under number 887 681 591.
Data controller
CLV is the data controller within the meaning of the General Data Protection Regulation (GDPR) for the collection and processing of personal data.
The user
Users declare that they have the capacity and authorisation required to give their consent. The category of persons concerned by the collection and processing of Personal Data by CLV are the Users of the www.tut-tut.com website.
Terms of digital consent
The user declares that he/she consents to and is fully aware of the processing of this Personal Data for the purposes set out below. This consent will be obtained when creating an account on the Site or the application, or when sending the various forms accessible on the Site, by ticking the appropriate box. By doing so, the User declares that he/she accepts this Privacy Policy without restriction or reservation before being able to access the Site's Services.
This consent may be withdrawn at any time. If the User refuses this Charter, he/she will not be able to access the services offered by the Tut-Tut platform.
Object
By means of this Charter, CLV provides all the legal information required of Users of the platform concerning the protection of their personal data and privacy.
CLV makes this Charter available in compliance with the regulations in force, in particular the General Data Protection Regulation of 14 April 2016 known as the «RGPD» and the amended «Informatique & Libertés» law no. 78-17 of 6 January 1978, as well as the «pour la confiance dans l'économie numérique» law no. 2004-575 of 21 June 2004.
Definitions
« Retailer »Professional": refers to a professional who has registered on the Site in the Merchant category in order to benefit from the service of establishing contact with a courier and ensuring the delivery of one or more Parcels for his/her benefit in the course of his/her business activity.
« Account »Account": refers to the account that must be created on the Site when a User registers.
« Race »Delivery": means the transport of a Parcel by a delivery person.
« Courier »Courier": refers to an individual who has registered on the Site in the Courier category in order to benefit from the service of establishing contact with a Shipper and ensuring the delivery of one or more Parcels on his behalf when travelling for private purposes on his own behalf.
« Personal data »or« Personal data »information": refers to any information relating to an identified or identifiable natural person.
« Sender »Sender": refers to a person, individual or professional, or a company, who has registered on the Site in the Sender category in order to benefit from the service of establishing contact with a Courier or a Carrier for the purpose of delivery, by the latter, of one or more parcels.
« Delivery driver »This includes couriers and transporters.
« Website »refers to the matchmaking platform accessible on the www.tut-tut.com website and/or on one of the mobile applications (particularly ios and android).
« Carriers »Carrier": refers to a professional carrier who has registered on the Site in the Carrier category in order to benefit from the service of establishing contact with a Shipper and ensuring the delivery of one or more parcels on his behalf.
« User »Shipper": refers to a Shipper, a Courier, a Carrier or any person using the Site even if they do not hold an Account.
Collection and processing of Personal Data
Legal basis
The collection and processing of Tut-Tut Users' Data is carried out on the basis of defined legal bases:
- Performance of the contract
- Consent
- Legitimate interest
- Legal obligations (regulated profession of Carrier)
Collection methods
Data is collected and processed from the Account creation form, using Personal Data sent for Account confirmation (including supporting documents requested by Tut-Tut), and via Personal Data transmitted to Tut-Tut from your Tut-Tut Account or using third party services.
Purpose of data collection
Tut Tut processes your Personal Data in order to offer you its matchmaking service, which includes very specific purposes:
- Managing your account on the platform
- The provision of the introductory service for a Race
- Payment for a Race
- Customer Relationship Management
Data Categories
Personal data processed
To achieve the purposes set out above, Tut Tut specifically processes some of your Data.
Shippers' data
The Shippers' Data processed are :
- Identification details: surname, first name, full address, e-mail address, telephone number.
- National identity card
- Financial information: IBAN details
- Geolocation coordinates
- Data relating to the performance of the service
- Account and application connection data
Courier data
The Couriers' Data processed are :
- Identification details: Last name, First name, Full address, E-mail address, Telephone number.
- Means of transport
Projected movements and related criteria. - Official documents such as your driving licence, third-party insurance and vehicle registration document.
Your national identity card. - Financial information: IBAN details
- Geolocation coordinates
- Data relating to the performance of the service
- Account and application connection data
Carrier data
For Carriers, in addition to collecting the same Data as for Couriers, there are also :
- A Kbis certificate less than 3 months old
- The current articles of association
- Declaration of beneficial owners
- The manager's identity document.
Merchant data
If you are a retailer, we collect :
- Identification details: surname, first name, town, e-mail address, telephone number.
- Information about your company: company name
- Financial information: IBAN details
- Data relating to the performance of the service
- Account and application connection data
Data collected from third parties
By registering on the Tut Tut platform through third party services, you allow the latter to communicate to us the Personal Data necessary for the creation of your account such as your surname, first name, address, age and e-mail address.
Data storage
Duration of data storage
Personal Data is processed for a maximum period of three (3) years from the last connection to the Tut Tut Account or from the deletion of the Account (whether deleted by virtue of non-compliance with the TOS or deleted at the wish of the User).
Data transfer
CLV does not sell your Data to any third party. It is used strictly for the purposes and in the manner to which you have consented. Only persons authorised to ensure the proper functioning of the service and subcontractors will have access to your Personal Data.
Thus, a transfer of this Data may take place within the framework of our subcontracting relationships. CLV may transfer your Personal Data to its subcontractors, which are :
- The Stripe payment service (stripe.com/en/privacy)
- The SendinBlue customer relationship management software publisher service
Registration with the Payment Service Provider
As part of the payment process, the User, when creating an account, provides Data in parallel to the service provider Stripe, which will subcontract certain Data. The purpose of this Data is to enable the sum to be released and transferred from the Sender to the Deliverer once the Purchase has been completed.
Thus, by using the Site and by using Stripe's payment services, Users undertake to read and accept Stripe's framework contract for payment services.
Stripe uses the SSL (Secure Socket Layer) protocol to encrypt credit card details. No credit card number is therefore stored on Tut Tut's computer servers.
Storage location and security
The Personal Data collected is hosted by HELIOS INFORMATIQUE.
HELIOS INFORMATIQUE is a simplified joint stock company with capital of €333,200.00, registered with the Orléans Trade and Companies Register under number 334 097 862 and whose registered office is located at 23 RUE BERNARD PALISSY, 45800 SAINT-JEAN-DE-BRAYE France. This website can be accessed at the following address: https://www.helios.fr/.
CLV implements physical, logical, technical and organisational security measures to protect Users' personal data, in particular by archiving, implementing software protection measures and encrypting personal data, in order to guarantee the confidentiality, integrity and retention of data and prevent any unauthorised access.
The data controller undertakes to notify the competent authorities of any breach of the data system as soon as it becomes aware of it.
In the event of a personal data breach, the data controller will notify the User as soon as possible of the information required pursuant to Article 33 of the RGPD by email.
Your rights
The RGPD offers you a range of rights to maintain control over your Personal Data. For example, you can access your data, rectify it, request that it be deleted or exercise your right to limit the processing of your data. You also have the right to:

- To withdraw your consent at any time; ;
- Opposition
Any request to exercise rights, and in particular the right of access, will be processed within the legal time limit in force (one (1) month). Requests that are too complex or manifestly abusive may require payment of a sum corresponding to the administrative and technical costs of making the Data available.

Update
CLV may modify its Personal Data Charter at any time. In this case, the latest version of the Charter will prevail. CLV therefore invites Users to consult the updated Charter on a regular basis.
Litigation
In accordance with the applicable regulations, in the event of failure of any amicable attempt concerning the personal data that CLV collects and processes on its Sellers, the competent body to assert one's rights is the Commission nationale de l'informatique et des libertés (CNIL) in France. In the event of a claim for compensation, the Courts of Avignon shall have jurisdiction.
