Users and co-transporters are solely and entirely responsible for their use of the Service.

Tut Tut does not intervene in any way in the agreement concluded between a Shipper on the one hand and a Cotransporter on the other hand, in respect of a Journey, the Service being limited to putting them in contact with each other to the exclusion of any other purpose, and cannot therefore be considered as a party to this agreement.

Tut Tut has neither the quality of transport company commissioned by the Advertisers, nor the quality of employer of Cotransporteurs, or more generally of agent or representative of its Users.

These GCU are in no way intended to govern the contractual relations between Users during a Race. In this context, Users act under their sole and entire responsibility, in particular in accordance with the provisions of the Civil Code relating to the law of obligations and contractual civil liability (article 1101 et seq. of the Civil Code).

Any use of the Platform is subject to these General Terms and Conditions of Use, which prevail over any other document, unless otherwise agreed in writing between CLV and the User. 5. Use of services

5.1 Submitting and confirming an Advertisement

In order to make a Delivery request, a Shipper must place an Advert on the Platform. Various criteria describing the Delivery must be entered, including the collection point, the destination, the type of parcel and the period of validity of the Advert.

The Fare for the journey is automatically calculated by Tut Tut in the light of the criteria entered, allowing the application of a price scale that takes these criteria into account. It is then displayed so that the Shipper can, depending on whether this Tariff suits him, confirm his Advertisement or not.

Upon confirmation of the Advertisement by the Advertiser, notifications are sent to all available Cotransporteurs corresponding to the criteria of the Advertisement.

5.2- Booking and running the Race

Booking a journey implies acceptance of the delivery conditions stipulated in the advertisement.

In accordance with the legal and fiscal regulations governing the co-transport of parcels, the co-transporter, before accepting a Journey, undertakes to ensure that the Share of the costs to which he is entitled complies with the concept of sharing his travel costs relating to the said Journey as referred to in Article L 3232-1 of the French Transport Code. .https://www.legifrance.gouv.fr/codes/section_lc/LEGITEXT000023086525/LEGISCTA000039675145/#LEGISCTA000039675145

A Collection Key is sent to the advertiser. This Collection Key must be communicated to the co-delivery agent when the Parcel is collected, and must be filled in by the co-delivery agent on the platform to enable the Race to start.

A text message is then automatically sent to the recipient to inform them of the start of the Race, including the Delivery Key.

On receipt of the Parcel, the recipient must give the Cotransporter the Delivery Key which the latter must enter on the platform in order to confirm delivery.

Tut Tut reserves the right to verify the services provided.

5.3- Cancellation of a validated Race

Any changes to the Advertisement are possible, except if they concern the collection and destination addresses, and/or the size of the parcel.

The modification is at the Advertiser's discretion from the Platform as long as the race has not been booked. In the event that the race is already booked, the Advertiser must contact Tut-Tut.

Race cancellation conditions are defined below:

5.3.1 - Cancellation of an advert with the status «awaiting courier» :

Waiting for a courier« means that no Cotransporter has booked the journey.

No charges will be applied and the Advertiser will be refunded the full Price.

If the cancellation request is made during the Race slot, The Advertiser will be reimbursed for the fare paid, with the exception of the Service Fee, which will remain the property of Tut Tut, and a cancellation fee of €5 including VAT for the Cotransporter who booked the journey.

5.3.3 - Cancellation of an advert with the status «in progress» or «delivered»:

The «in progress» status means that a Cotransporter is en route with the parcel.

When collecting the Parcel to be delivered, the Cotransporter undertakes to check its condition and may refuse delivery if it does not comply with the description in the Request (dimensions, volume, weight etc). Or if the packaging of the Parcel does not allow it to be transported under good conditions. The Carrier must immediately inform Tut Tut by telephone during normal business hours or by email to : [email protected].

Tut Tut assesses at its sole discretion, on the basis of the elements at its disposal, the legitimacy of requests for reimbursement it receives as part of a claim.

Tut cannot guarantee Advertisers that a Co-transporter will always be able to make a delivery on their behalf and vice versa.
